Lundgren, Judge, and a jury, and a verdict of $5,000 returned for plaintiff. Upon defendants motion for a new trial, the court granted the motion unless plaintiff should consent to a reduction of the verdict to $4,000, in which case the motion was denied. Plaintiff consented to the reduction, and defendant appealed from the order.
